Proposed “Hero Pay” for grocery store workers in Los Angeles and Moncton

Seyfarth Synopsis:
The Los Angeles County Board of Supervisors and Moncton City Council directed their attorneys to draft regulations that would require certain grocery stores to pay their employees an additional five and four dollars an hour, respectively. The Los Angeles Ordinance is intended to apply only to companies located in unincorporated areas of Los Angeles County. However, the board is reviewing its authority to extend the scope of emergency ordinances to include incorporated areas. The Los Angeles Ordinance is expected to be drafted ahead of the January 26, 2021 Board of Directors meeting, and the Moncton Ordinance is expected to be rolled out shortly.

Proposed Los Angeles Ordinance

The Los Angeles Board of Supervisors suggests one regulation
For 120 days, the grocery workers’ salary must be increased by $ 5 an hour.

To Who would the regulation apply to? The regulation would apply to companies in the unincorporated areas of the county that:

  • are included in Appendix B-1 of the Los Angeles County Department of Health ordinance, which is designed for a temporary order from a home health officer (i.e., grocery stores, grocery stores, convenience stores, liquor stores, and other retail locations that sell food or beverages and about Have a health clearance issued by the Department of Health – Appendix B-1 may contain drug stores, grocery stores, and retail locations that sell foods covered by the California Retail Food Code);
  • are listed or have at least 300 employees nationwide; and
  • have more than 10 employees per site.

How long would the regulation take?

The regulation would apply for 120 days from the date of its entry into force. The Supervisory Board will meet on January 26, 2021 and examine the draft ordinance during this meeting.

Possible effects on incorporated areas

The Board of Supervisors will examine whether such an emergency ordinance could apply to both unincorporated and registered areas of Los Angeles County.

Proposed Moncton Ordinance

Similarly, the City of Moncton directed their attorney to draft an emergency ordinance to be considered at the next city council meeting to give frontline grocers $ 4 an hour “hero pay”. The ordinance is expected to expire 120 days after its approval. At the time of publication, the ordinance has not yet appeared as an item on the agenda for an upcoming city council meeting.
